Minutes From Board Meeting

August 10, 2007


Board members in attendance included Dave Anderson, John Ragosta, Pat Moyer, Bob Parker, Nick Binder, and Bill Walton. President Dave Anderson called meeting to order. Dave Anderson presented the Board with a letter from John Nock to the City of St. Augustine Beach dated October 4, 2006. While we were copied on the letter we never received until now. The letter was given to Dave by the City of St. Augustine Beach last week outlining Nock’s acknowledgment of some liability for damages but not all the damages WOHA is citing. WOHA was not aware of this letter until it was presented to us by the city. Board agreed to set up a meeting with Beachfront Properties to see if we could work out a compromise between what WOHA feels they are liable for and what John Nock believes they are liable for. WOHA originally asked for $7,500 which included (40 for irrigation system damage, $3,000 to replace electrical work and lighting, $3,100 to replace damaged landscaping, and $250 for removal of tree damaged by the developers. In his letter John Nock agreed to liability of $940 for the irrigation system only.

Board agreed to contact John Nock to set up a meeting to discuss a compromise, Dave said he would call John Nock and notify Board members of a time and location of meeting to discus compromise.

Pat Moyer informed the Board the new gate would be installed August 13, 2007. Bill Walton reported on road resurfacing. He met with Duval Asphalt and discussed damaged parts of road that would need to be repaired as well as a 1” overcoat on the roads instead of ¼” overcoat. Bill was told that if we did the whole project at one time it would have to be build at the commercial rate because of volume. If we broke it into phases it would be billed at the lower residential rate. Bill is waiting for an estimate but will continue to look for other vendors.

Nick brought up that he believed the condo developers were tapping into our water supply causing our electric bill to increase $20 to $40 a month. Board agreed to bring the matter up at our meeting with the developers to discuss a compromise on damage liability.

Pat suggested we remove the dwarf oleanders planted by the pond across from MacDowell and replace them with standard size oleander to provide better screening. Removed dwarf oleander would be placed around pond across from Bill Walton. Bill agreed to do any additional work around the pond with a neighbor. Bill also brought up a bulkhead on Whispering Oaks Circle that was in disrepair. No one on the Board was sure if it was owned by a WOHA member or common property. It was agreed to determine ownership and review the covenants to determine responsibility for the bulkhead.

ARC submitted a report to the Board of potential violations of Covenant 4.5 covering appearance of landscape. Dave Anderson and John Ragosta agreed to survey properties listed on August 18, 2007.
